In California, divorce mediation is a confidential process where a couple elects to jointly hire a neutral, third-party individual who assists them with discussing and negotiating the settlement of their divorce proceeding outside of court. Mediation sessions occur with both parties and the mediator privately either in an office conference room or over remote video conference. The discussions and communications between the mediator and the parties are confidential and cannot be publicly disclosed in the parties’ divorce proceedings.
